Terms of Service

1. Acceptance of terms

By downloading or using Tobi ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms form a binding agreement between you and Ancillary.dev LLC ("we", "us", "our").

2. Description of service

Tobi is an iOS application (iPhone and iPad) that converts EPUB and PDF ebooks into AI-generated manga graphic novels using artificial intelligence. The service includes:

• AI-powered conversion of book text into sequential manga panel images
• A library of free public domain books via Project Gutenberg integration
• A community Explore feed showing conversions made by other users
• Optional paid subscriptions via Apple In-App Purchase

3. Eligibility

You must be at least 13 years old to use Tobi. If you are between 13 and 18, you confirm that you have your parent or guardian's permission to use the App and agree to these Terms on your behalf.

4. Your content and books

By importing a book into Tobi, you represent and warrant that:

• You have the legal right to use the book file in this manner
• The file is not DRM-protected
• Your use does not infringe any third party's copyright, trademark, or other intellectual property rights

5. AI-generated content and ownership

When you convert a book using Tobi, the resulting manga panel images ("Generated Content") are created entirely by Tobi's AI pipeline using third-party AI models (Anthropic and Replicate). You acknowledge and agree that:

• Tobi owns the Generated Content. All panel images are produced by Tobi's systems. By initiating a conversion you do not acquire ownership of, or any rights in, the resulting Generated Content.
• Irrevocable licence to Tobi: Generated Content is owned and operated by Tobi on an irrevocable, perpetual basis. We may store, display, distribute, and serve Generated Content to other users of the App as part of the community cache and Explore experience.
• Personal enjoyment: You may view and read your Generated Content within the App for your own personal, non-commercial enjoyment.
• Underlying work: Generating a manga adaptation of a book does not transfer, modify, or affect the copyright of the original book. The original book's copyright remains with its rightful owner.
• No personal data: Generated Content does not constitute personal data. It contains no information about you and is associated only with the book title and art style that produced it.

6. Prohibited uses

You agree not to use Tobi to:

• Convert books you do not have legal rights to process
• Circumvent or assist in circumventing DRM or copy protection
• Generate content that is defamatory, obscene, or illegal in your jurisdiction
• Generate content depicting real, identifiable individuals without their consent
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use the App in any way that could damage, disable, or impair our servers or infrastructure
• Attempt to manipulate the community cache or Explore feed
• Use automated tools to make requests to our API beyond normal app usage

7. Subscriptions and payments

Tobi offers the following tiers, available via Apple In-App Purchase:

All payments are processed by Apple. Prices are displayed in your local currency as determined by the App Store. We do not handle your payment information directly.

Refunds: All purchases are final unless required by applicable law. Refund requests must be submitted to Apple directly via reportaproblem.apple.com.

Cancellation: You may cancel your subscription at any time via App Store → Account → Subscriptions. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time.

8. Disclaimer of warranties

Tobi is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The App will be uninterrupted, error-free, or free of harmful components
• AI-generated panel images will be of any particular quality or accuracy
• The App will faithfully represent the content or tone of any source book
• Generated content will be suitable for any particular purpose

AI image generation is inherently variable. Results will differ between conversions even of the same book. We make no guarantees about the artistic quality of output.

9. Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Tobi, including but not limited to loss of data, loss of revenue, or damage to your device. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your access to Tobi at any time if you violate these Terms or engage in conduct we determine to be harmful to other users or to the service. Upon termination, your right to use the App ceases immediately. Locally stored content remains on your device until you delete the App.

11. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated via an in-app notification or by updating the "Last updated" date on this page. Continued use of Tobi after changes constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Wyoming.
